SECTION 1. ACCEPTANCE AND UNDERSTANDING

When using the site http://viajes-anita.com/ and http://reservas.viajes-anita.compor please read the Terms and Conditions carefully. These terms together with your booking confirmation email set out the legal terms by which the Travel Services are made available to you through our service. They also include any interaction or communication you have with us through our service.

The use of our service is conditioned upon your unrestricted and unconditional acceptance of the terms and conditions set forth herein. By using this website, the user is expressly accepting each and every one of the terms, conditions and notices set forth herein.

We may update these terms at any time and may make changes to any product, program or service without any notice and/or liability; your continued use of our Service after the effective date of any changes will constitute your acceptance of the updated Terms. All existing reservations will continue to be governed by the Terms that applied to your reservation at the time you made your reservation. We recommend that you keep or print a copy of these Terms.

The titles, subtitles and other headings included in this agreement have been used solely for the purpose of facilitating its reading and understanding, but at no time should they be used to interpret this agreement.

The information contained herein is basically informative and illustrative of the services we offer, and may eventually contain involuntary errors or omissions, arising during the loading of such information. VIAJES ANITA is not responsible for such errors, omissions or failure to update such information.

SECTION 2. STATEMENTS AND TERMS

It is understood that http://viajes-anita.com and http://reservas.viajes-anita.com, is property of AGENCIA DE VIAJES ANITA, S.A., a company duly registered in the Republic of Panama in accordance with the regulations in force, also described as VIAJES ANITA, with legal domicile in Panama City, Corregimiento de Bella Vista, Calle Manuel María Icaza, Edificio Magna Corp, first floor, Local 3.

The information contained in this Portal does not exclude the policies and guidelines of AGENCIA DE VIAJES ANITA, S.A.

Terminology
“We”, our“, “ANITA TRAVELS”, refer to AGENCIA DE VIAJES ANITA, S.A.,

“Customer” o “User”, When we say “you”, "you" refers to the person using our services,

“Content” means all text, descriptions, guest reviews, photographs, images, videos, software and other content provided or made available on our Service,

“Our service”, refers to the content offered on our websites, applications and online tools;

“Portal” o “Website” refers to the addresses http://viajes-anita.com http://reservas.viajes-anita.com and in case of mentioning another portal this will be duly specified.

“Supplier”, means a third party that provides services that are made available through our website.

SECTION 3: RULES AND RESTRICTIONS

In addition to these Terms, other terms and conditions provided by Travel Suppliers, such as the airline's conditions of carriage, the terms and conditions of a property or car rental company's rental agreement, etc., also govern your reservation.

To make a reservation, where applicable, you must accept the rules and restrictions of the Travel Supplier you select.

If you violate a Travel Supplier's Rules and Restrictions, your reservation may be cancelled and you may be denied access to the applicable Travel Service.

You may also forfeit the money you paid for such reservation, according to the Travel Supplier's Rules and Restrictions.

SECTION 4: USE OF OUR SERVICE

By using our services you agree that:

- You will only use our Service for personal and non-commercial purposes.
- You are at least 18 years old and have the legal capacity to enter into contracts.
- You will use our Service lawfully and in accordance with these Terms.
- All the information you provide is true, accurate, current and complete.

If you book on behalf of others:

- You will obtain their authorization before acting on their behalf;
- You will inform them of the terms governing the reservation (including the Rules and Restrictions) and ensure that they accept and comply with them; and
- You will be responsible for paying any amount due, for requesting any changes or cancellations and for all other matters related to the reservation.

You also agree not to perform the following actions:

- Make false or fraudulent reservations.
- Monitor, copy or access any content of our Service using any robot, web crawler, scraper or other automated means, or by any manual process.
- Violate the restrictions of the robot exclusion headers on our Service, as well as circumvent or bypass other measures used to prevent or limit access to our Service.
- Take any action that imposes, or may impose, a high or unreasonable burden on our infrastructure.
- Make deep links to some part of our Service.
- «Frame», «mirror» or otherwise incorporate any part of our Service on another website.

Access

We may reasonably deny anyone access to our Service (or any other sites, applications, tools and services you have access to on your ANITA TRAVEL Account, as defined below) at any time for any valid reason. We may also improve and change our Service at any time.

Account

In order to use all the features available on our Service, you will need to create an account with us and log in to it.
To create an account, you must be at least 18 years old and follow the instructions provided in our Service.

If you have an account with us, you will need to do the following:

- Protect your account information.
- Be responsible for any use you or others make of your account (including transactions you did not intend for them to be made).
- Notify us immediately of any unauthorized use of your account.
- Provide us with all necessary information, to the extent required to comply with our legal obligations.

SECTION 5. CONDITIONS AT THE TIME OF BOOKING.

For assistance or further explanation, please consult with an advisor regarding payment, cancellation, refund and penalty policies at the time of booking.


A. Search results:

There are many options available through our service, and we want your search results to be as relevant as possible.

On the search results page, you will see the results in a predetermined order; however, you can select how to sort your results and use the filter options to prioritize results based on your preferences, e.g., price, guest ratings or other criteria.

B. Redirection and third party reservation services:
Redirection from our service to a third party booking service may occur. (e.g., car rental) to book a trip, please note that any reservations made through this booking service will be with the third party and not with us.

We are not responsible for bookings made through third party booking services and have no liability to you in respect of that booking. The third party service provider's terms and conditions will set out what rights you have against them and explain what liability they have to you.

C. Tourist Plans or packages:
Reservations for tour plans can only be made up to 20 days before the date of the trip at least. For reservations less than 19 days before the trip, please contact VIAJES ANITA directly. Rates subject to change at the time of booking. Reservations are guaranteed only with full payment of the package.

In case of force majeure or fortuitous event before or during the trip (accidents, strikes, over sales, earthquakes, climatic factors, security conditions, political factors, denial of entry permits, health issues, among others), or simply in order to ensure the success of the plan, the operator and/or the agency may modify, replace or cancel itineraries, dates, flights, hotels, optional services, which is now accepted by the passenger at the time of acquiring the services.

VIAJES ANITA may inform the client of the restrictions established by the airlines regarding prohibitions, maximum weight and number of pieces per passenger, persons allowed in the attractions or tourist sites, limitations or impediments of access by maximum quota.

However, it shall be the sole responsibility of the passenger to comply with such policies, which may vary according to the service providers. All additional information regarding validity, conditions, departure and foreign taxes, fees, charges and other mandatory payments, preventive health measures of the destination, assistance services should be consulted with the travel consultant at the time of booking, likewise will be informed to the passenger in the travel documents, according to the characteristics that apply to each one, understanding that VIAJES ANITA has the appropriate information of the passengers, including copies of passports and other necessary information, as appropriate. Tourist packages are reserved in specific and previously assigned classes. Quotas are limited. Tourist plans are not endorsable, refundable or transferable for any reason. Changes and/or cancellations of services once the services are confirmed are subject to penalties.

The passenger who, for any reason, condition, negligence, illness, or non-compliance with the schedule described, does not use or enjoy the service, will not be entitled to any refund. VIAJES ANITA reserves the right to change itineraries, substitute hotels, travel dates and other services in order to provide the success of the tour plan. Other restrictions may apply.

D. Cruises:
The prices of the cruises are per person, minimum 2, traveling together and sharing the same internal/external double cabin with the most economical price available at the time of publishing the packages or promotions.

The Cruises reserve the right to change, advance, postpone or cancel promotions, itineraries and ships or substitute any scheduled cruise, without prior notice due to strikes, wars, occupations, riots, over sales, charters, weather conditions, natural disasters, mechanical difficulties or any other inconvenience. The cruises will not be responsible for non-compliance with the published arrival and departure times for any of the published ports and thus generating losses in air connections. The Cancellation Insurance offered by some cruise lines is optional and takes from 3 to 8 months to process claims and reimbursements, after presenting all the necessary evidence for the same. Cancellation Insurance must be paid in full from the moment the cruise is booked.

Restrictions apply for refunds, please consult us. The refund will arrive to the passenger, deducting the cost of insurance and processing fees. VIAJES ANITA is an intermediary between the shipping company and the insurance they offer and the clients, therefore, does not assume responsibility for problems or delays generated with the insurance company.

Special conditions may apply for seniors over 65 years of age, please consult. No refund will be made if the passenger does not show up for the cruise, likewise no refund will be made if the passenger interrupts or cancels the cruise once it has started or if he/she shows up at the port with an expired passport or without the required visas. All name substitutions or changes in cruise departure dates once the reservation has been confirmed and paid for will be considered cancellations. Depending on the cruise cancellation dates, additional charges established by the cruise lines will apply.

Reservations that have not been paid in full before the deadline for final payment will be subject to cancellation.

If reservations that were not paid on the established dates are cancelled, the same price is not guaranteed when rebooking and those reservations that were already in penalty period are not refunded for any reason. Tipping on cruises is mandatory and can be prepaid at VIAJES ANITA. It is recommended to book restaurants, shows and tours as soon as the total payment of the cruise is completed. These conditions are subject to change without prior notice. General conditions, payment policies, changes and cancellations for individuals and groups can be found on the web pages of each cruise line and in their respective terms and conditions of service.

E. Group Reservations:
With the confirmations, the dates of delivery of names, changes of the same, the policy of changes and/or cancellations depending on the airline, hotel, cruises, tourist services and other contracted entities, in addition to the penalties that are generated by changes will be established. Special specifications for the group must be provided at the time of the group reservation request (meals, language of the guides, special visits, etc.).

Rates are based on the initial number of passengers; if the number of people in the group changes, a new quotation must be made and the previous prices are not valid; the same applies for changes of dates. Refunds once the services have been paid are subject to the policy of each entity involved.

F. Air transportation - Flights:
The Rules and restrictions of the Travel Suppliers offering Air Travel Services are made available prior to making a reservation and must be reviewed and accepted by the CUSTOMER.

If you pay for a flight-only reservation (which is received on behalf of the Travel Supplier), we will act as representatives of the Travel Supplier. The contract for the flight is between you and the relevant Travel Supplier.

The price and availability of your flight can only be guaranteed once the Travel Service purchase is complete and your tickets are issued.

Low cost flights
Some low-cost airline flights can only be changed or cancelled if you contact the airline directly. We may not be informed if you change or cancel a flight with the airline directly, or if the airline changes the flight schedule. Also, such changes may not be shown on the itinerary we provide to you through our Service. We recommend that you print any e-mail with an itinerary change that you receive directly from the airline.

Site redirection
On occasion, you may be redirected from our Service to the airline's website to complete your reservation and pay. Your contract for any such booking is with the applicable airline's Travel Supplier. We have no relationship with or responsibility for these reservations.

Flight terms and conditions
You understand and agree that:
- Airlines are ultimately in control of their schedules and may change or cancel your flight for a variety of reasons, such as mechanical problems or adverse weather conditions, etc. Whenever the airline provides us with information about a change or cancellation of your itinerary, we will let you know and help you evaluate your options. You should always check the scheduled departure time of your flight before traveling.
- Seats are controlled by the airlines and we do not guarantee the availability of specific seats, even when reserved in advance.
- If you book a round-trip flight and do not use the outbound flight, the airline may cancel the return flight without refund.
- For special or charter flights, the airline, flight schedule, aircraft type, itinerary and possible stopovers are provided as a guide only. As these details may be subject to change, even after confirmation, please read the applicable Rules and Restrictions before booking.
- Some airlines impose additional charges for meals, baggage, seat selection, etc. Unless we provide these optional services for booking through our Service, all references to these optional and additional services and related charges displayed through our Service are for informational purposes only and may be updated by the airlines at any time. When we provide you with the option to book these additional services through our Service, you will be shown the price of the optional add-ons and, after you select them, they will be added to your price.
- You must follow the applicable rules and restrictions regarding travel with minors. Children who are two years of age or older on the date of return must have a round-trip ticket at the child fare for both the outbound and return flights. You will not be entitled to a refund of seat charges incurred during travel if you do not qualify. Children under the age of two will not be assigned a seat of their own unless they have been ticketed at a child fare. Unaccompanied children under the age of 14 may only fly in accordance with the applicable Rules and Restrictions.
- It is generally prohibited to carry hazardous materials on board aircraft, either in your baggage or with you.

Air miles and coupons
Air miles and loyalty program coupons cannot be used to book flights through our Web Platform Service.

Airlines operating the flights
Sometimes flights booked with one airline are operated by another airline. When this happens, details of the airline operating the flight are displayed through our Service. The airline issuing your ticket will charge you for the flight and will appear on your payment method statement.
If you cancel or do not show up
In case of no-show or cancellation, there is the possibility of being entitled to a refund for taxes and airport charges that are included in the price of the purchased flight. In this case, you can request this refund from us and we will forward the request to the airline on your behalf.
Airline liability
Laws, treaties and airline rules and restrictions normally limit your liability for death, personal injury and other damages.

G. Car rental:
When you pick up the rental car, you or the driver must present a valid credit card. You should check with the Travel Supplier which credit cards they accept. Debit cards are not accepted. The Travel Supplier may submit an authorization request to your credit card institution during the rental period as a deposit. You or the driver must ensure that you have a sufficient credit limit for this purpose. For some larger car rental categories, you may need to use two credit cards.

If you do not comply with the above rules, the Travel Supplier may not make the vehicle available to you. You may also be required to pay an amount that may be up to the full price of the car rental provided by Travel Services, in accordance with the Rules and Restrictions.

Additional Services
You may have to pay the Travel Supplier additional charges at the local level. For example, these charges may include refueling, snow tires, additional driver charges, young driver surcharges, child seats, delivery and pick-up charges, etc. Neither we nor the Travel Suppliers are responsible for paying these additional charges. Requests for optional extras (such as child seats) cannot be guaranteed, as they are subject to availability.

Fuel is generally not included in the rental price. In some countries, certain Travel Suppliers may charge you for refueling when you return the vehicle. Unless otherwise agreed, you must return the rental car to the same branch of the Travel Supplier from which you picked it up.
Pick-up and use of rental cars

Drivers must be between 21 and 75 years of age, although this may vary by Travel Supplier and country of rental. It is your responsibility to check with the Travel Supplier. Additional charges may apply if the driver is under the age of 25 or over the age of 70.

When you pick up the rental car, you or the driver must present a valid and complete driver's license for the category of the rented vehicle. International rentals may have different requirements for driver's licenses. Check the exact documentation requested by the Travel Supplier. For example, if the driver's license is not in Latin script, an international driver's license must be presented. If the vehicle is being delivered to an EU country, persons whose driver's license was not issued in the EU will be required to present an international driver's license. Additional documentation, such as a passport or up to two personal data certification forms, may also be required.

Generally, you will not be allowed to take the rental car out of the country where it was rented, nor transport it by ferry; and other restrictions may also apply.

Cancellation of reservations and unused rental days
No refunds will be provided for reservations cancelled within six hours prior to pick-up or for unused rental days.

SECTION 6: CONFIRMATION OF RESERVATION

Basic information, such as the description of the booked Travel Services and the price, is included in the Booking Confirmation.
We will send you a Reservation Confirmation and all relevant travel documents to the e-mail address you provide when making the reservation.

If you do not receive a Reservation Confirmation within 24 hours of making your reservation, please contact a consultant directly.

SECTION 7: OTHER RESERVE CONSIDERATIONS

Our prices do not include

According to the description of the content of the packages or tours may not include airline and airport taxes, gasoline and security “Qs” where not specified; visa and passport fees, excess baggage, tips, extras of any kind in hotels and cruises, transfers and hotel nights where not specified, airline tickets where not specified, telephone calls, Internet (in some cases), mini bar, room service, laundry, personal expenses and anything not specified in the tour packages. On cruises, tips (mandatory), port taxes, beverages and land excursions may not be included.
Prices and currency: The prices shown on our website are in US dollars.

Immigration requirements: You must verify that your passport is valid for more than six months before your departure date. If you are traveling with a minor, you must corroborate the permission to leave the country. In addition, you must make sure that you comply with the VISA and/or the respective vaccinations according to the destination.

Fees: They are NON-REFUNDABLE / NON-REFUNDABLE. The quoted fare is guaranteed once the ticket is issued. Fares are subject to change without notice. Once issued the ticket does not allow name or route changes.

Cancellation fees or penalties on airline tickets: Penalties apply for changes and cancellations, after the ticket has been issued. These vary according to the specific conditions of the fare and the airline.

In the case of airline tickets, we remind you that, according to airline reservation policies, it is not allowed to book and cancel the same flight more than three times. If this situation occurs, a penalty charge of between $30.00 to $75.00 will be applied, which will be charged to the user or his/her representative when applicable.

Other inclusions: Transportation, general admissions, guided or self-guided tours, tours, cruises and other complementary services are only included when expressed in the programs. Anything not expressly included in the respective programs is excluded.

Personal expenses: Expenses of a personal nature of the clients/passengers, such as telephone calls, laundry, tips, services requested in the room, optional tours, beverages, etc. are not included and will be at their own expense and contracted at their own responsibility.

Baggage: On domestic flights, there is a small baggage allowance. Excess baggage charges are the sole responsibility of the customers/passengers. Please refer to the information provided by the airline and/or operator with whom you have contracted air transportation services regarding the amount of baggage allowed and additional costs for excess weight and/or number of packages.

Exit or entry taxes: (departure or boarding taxes).

The programs exclude international and/or domestic departure or entry taxes. International departure or entry tax must be paid before proceeding with immigration and customs procedures. Please check current rates with the operator with whom you are contracting international and/or domestic transportation services.

Service Vouchers

Service vouchers are not valid if presented with erasures or amendments. The passenger must present the service vouchers to the contracted suppliers as proof of payment. VIAJES ANITA declines all responsibility if the contracted services in case of loss, deterioration or if the passenger fails to deliver them at the time.

SECTION 8. PAYMENTS

VIAJES ANITA receives as a form of payment deposits or bank transfers to accounts in the Republic of Panama, for reservations made directly at the Travel Agency. The schedule to receive bank deposits for airline tickets, cruises and reservations in general is from 9:00 am to 5:00 pm from Monday to Friday and from 9:00 am to 11:00 am on Saturdays, Panama time (not applicable on holidays), it is understood as receipt of deposit or bank transfer the effective availability of funds in the bank account. It is also received as a form of payment, cash, certified checks made out to VIAJES ANITA, credit cards: Visa, Mastercard and American Express.

For reservations made through our digital platform, only credit card payments are accepted.
Payments made by bank transfer are free of charge. VIAJES ANITA will accept as payment for the contracted services the amount actually credited to your bank account, net of any transfer fees charged by the issuing and correspondent banks. Any difference that may arise will be the client's responsibility to settle through any available payment methods.

Reservations are guaranteed only when payment is cleared with the bank. If the bank deposit was made by check the reservation will be confirmed when the check clears the bank. Until the check clears, neither the reservation nor the rate is guaranteed and there is a risk of cancellation of the reservation without responsibility of VIAJES ANITA. The information provided must be the same as that which is on file with your financial institution (identity card, names and surnames, address and e-mail, telephone numbers).

 On the date of purchase, the current rates and taxes and fees applicable at that time will be applied. Payment for online reservations can only be made to guarantee the quota and price. The administrative fee and handling fees charged on our website are not refundable in any case. In case of any inconsistency in payments, your reservation may be cancelled.

Payment in installments:

The client will have the option to pay in installments for which he/she should contact Asesor to apply this payment method in any of our packages.

SECTION 9. USE, SCOPE AND LIABILITY

Our service provides the CUSTOMER with personalized services through relevant content according to their profile, which may also register and thus receive promotions even closer to their interests, for which the CUSTOMER accepts these conditions.

Our service is not responsible for any damage or virus that may affect any customer's equipment, either by extraction, downloading or copying of information, image or sound. In the same way, no supplier will be responsible for this same effect.
The CLIENT is responsible for the activities on the Web Site, at the same time to take care of their data, keys and passwords, to avoid the misuse by third parties of their personal accounts. In case of fraud or theft of information, it is the responsibility of the customer the activity that this act results in fraud or loss of information.
The client may use the Travel Compositor tool integrated into the site to make reservations directly, without the need for agent intervention, subject to the Terms and Conditions described here.

Travel Assistance Insurance
For contracting, assistance or more information please contact a consultant.
It is the responsibility of all passengers to travel with Travel Assistance Insurance for any eventuality that may occur during the trip. The insurance company is responsible for providing assistance abroad in case of lost luggage, illness, sudden death, legal assistance, trip interruption and more. VIAJES ANITA declines all responsibility for any problems that may occur to passengers abroad because they have declined to purchase travel insurance.

The Traveler's Assistance Insurance will provide assistance in the event of the sudden onset of an illness or injury, which affects or makes it impossible for the holder of the Assistance Insurance to continue his/her trip; it does not apply to pre-existing illnesses; the holder may request assistance by contacting the telephone numbers indicated on the card and providing the holder's personal information.

The Assistance Insurance Headquarters will proceed to give instructions, assistance and the corresponding authorizations if required by the case. When due to duly justified emergency circumstances, the coverage holder is unable to call the Assistance Insurance and must resort to other physicians, the Assistance Insurance will reimburse the expenses incurred in these circumstances under the following conditions: to be entitled to this reimbursement the holder must communicate to the Assistance Insurance, by himself or through a third party, within 24 hours of the occurrence of the event, the information on the emergency suffered, the assistance received and the expenses incurred up to that moment.

The reimbursement of these expenses must be previously authorized by the Medical Department of the Assistance Insurance, which will request all pertinent original documentation proving the receipt and origin of the service and/or purchase of the prescription drugs for which reimbursement is requested. In no case shall assistance or reimbursement be made unless all the above mentioned requirements have been complied with. The total amount of expenses and assistance will depend on the product purchased. Travelers Assistance Insurance reserves the right to change assistance conditions, policies, general conditions and others without prior notice. Additional information is available at the time of purchase.

Passports and Visas
It is the responsibility of each passenger to travel with a valid Passport and equipped with all the necessary visas and requirements. In case a visa is required, VIAJES ANITA will provide the necessary advice, however, it will be the exclusive autonomy and responsibility of the consular authority, all matters relating to the process, the documents requested, the study, costs, duration of the process and the approval or rejection. In case of visa refusal, there will be no reimbursement of the sums paid by the applicant. The availability and presentation of the original passport of the passenger or passengers is the responsibility of the client at the time of requesting quotes, reservations or payments in VIAJES ANITA, so that the staff can verify the expiration date and nationality, the above does not apply to online transactions, being the sole responsibility of the user its verification.

The non-presentation described above, exonerates VIAJES ANITA from all responsibility in the event of rejection of the passenger or passengers by any authority in a country, for lack of any of the requirements that are specified or defect in the passport and shall be borne by the passenger, any expenses arising for this reason. Passports must be valid for at least 6 months before the trip to be able to leave the country, this is an international measure and applies to any destination. Yellow Fever vaccine is required for some destinations and measles vaccine is recommended for the United States.

Conditions for Group Reservations
For contracting, assistance or more information please contact a consultant.
To guarantee group reservations, an initial deposit per person is required and will be established at the time of confirmations. The deposit is non-refundable if the group does not travel or cancels the reservation. With the confirmations, the dates of the final payments will be established, which are mandatory and in case of non-compliance may result in surcharges and penalties. With the confirmations will be established the dates of delivery of names, changes thereof, the policy of changes and / or cancellations depending on the airline, hotel, cruises, tourist services and other contracted entities, in addition to the penalties that are generated by changes.

Special specifications for the group must be provided at the time of the group reservation request (meals, language of the guides, special visits, etc.). The quotations provided are made based on the initial number of passengers; if the number of people in the group changes, a new quotation must be made and the previous prices are not valid; the same applies for changes of dates. Refunds once the services have been paid are subject to the policy of each entity involved.

In some cases there will be no reimbursement for any reason. VIAJES ANITA reserves the right to cancel reservations that are not paid within the term established in the confirmation form or group contract.

In the case of online group contracting, no credits are applied, payment is in cash through credit card.

SECTION 10. CANCELLATIONS AND RESERVATION CHANGES

Reservations and payments:
Failure to pay according to the terms and conditions set forth in the terms and conditions set forth on the website entitles VIAJES ANITA, to cancel the reservations.
All reservations made online must be paid in full.

Modifications to reserves:
In the event of a request to modify a confirmed reservation, VIAJES ANITA reserves the right to apply a minimum administrative fee of $50 (fifty US dollars).

Cancellations
If you need to cancel a confirmed reservation more than 35 days before your arrival date, you will be entitled to a refund of the amount paid less a cancellation fee of $250 (two hundred fifty dollars). If you paid less than $250, you will not be eligible for a refund.

In the event that you need to cancel a confirmed reservation between 34 and 21 days prior to the arrival date, the cancellation fee will be the equivalent of 25% of the total price of the contracted services. Provided that such amount is not less than 250 of the applicable cancellation fee.

In the event that you need to cancel a confirmed reservation between 20 and 10 days prior to the arrival date, the cancellation fee will be equivalent to 50% of the total price of the contracted services. Provided that such amount is not less than 250 of the applicable cancellation fee.

If you need to cancel a confirmed reservation within 9 days of your arrival date, the cancellation fee will be equal to 100% of the value of the contracted services.

Refunds
Those activities and excursions booked by VIAJES ANITA as part of the contracted services and that could not be carried out due to weather conditions (very general I consider should be specified) will be refunded in full.

This refund does not apply to cancellations due to force majeure (war, terrorism, siege, natural or nuclear disasters, epidemics, quarantines, customs or medical regulations, fires, labor disputes or strikes, etc.).

In the case of contracting travel programs, there shall be no right to reimbursement for services included and/or contracted, but not used during the program by decision of the clients/passengers, such as lodging expenses, car rental, excursions, etc.

SECTION 11. NOTIFICATIONS

Once the customer has made a reservation, confirmation will be sent to the e-mail address provided during the booking process.

Notification of price variation:

All prices are subject to change and variation. In the event of any fluctuation in prices, fees, taxes, or any other element that affects part or all of the price of the contracted services, VIAJES ANITA undertakes to notify you of such variation or fluctuation as far in advance as possible.
The changes and/or variations of prices originated by the causes indicated in the previous paragraph must be paid by the clients/passengers before the beginning of the contracted services, for which the payment conditions established in the terms and conditions herein apply.

Notification of problems and inconveniences:

If any problem or inconvenience arises during your trip, it is very important that you inform us immediately so that we can assist you in resolving it and minimize any possible adverse effects. If for any reason you are unable to inform us of the problem, please inform us in writing within 30 days of your arrival in your country, providing all relevant information.

If possible, we will help you in any way we can to find a solution to the problem.

Notification of special needs

VIAJES ANITA undertakes to make every effort to meet any special requirements (e.g. special diets, persons with special needs, etc.) and to inform suppliers of your request when you make your reservation.

It is important that you inform us of these special requirements in detail and as far in advance as possible.

SECTION 12. INTELLECTUAL PROPERTY

All rights, titles, and interests in and to VIAJES ANITA, including any and all copyrightable materials or any other content thereof that is or may become subject to intellectual property rights under any applicable law (including all artwork, graphics, images, photographs, videos, website templates and widgets, literary works, source and object code, computer code (including html), applications, audio, music, video and other media, designs, animations, interfaces, documentation, derivatives and versions thereof, the “look and feel” of VIAJES ANITA’s methods, products, algorithms, data, interactive features and objects, advertising and acquisition tools and methods, inventions, trade secrets, logos, domains, custom URLs, trademarks, service marks, trade names, and other proprietary identifiers, whether or not registered or registrable (collectively, “Intellectual Property”), and any derivatives thereof, are owned or licensed by VIAJES ANITA. ANITA.

The VIAJES ANITA Terms and Conditions do not transfer any right or interest in VIAJES ANITA's intellectual property (or any part thereof). Nothing in the VIAJES ANITA Terms and Conditions constitutes a transfer or waiver of VIAJES ANITA's intellectual property rights under any law.

We are not and will not be obligated (1) to keep any comments secret; (2) to pay compensation for any comments; or (3) to respond to any comments.

In no case shall VIAJES ANITA, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the travel agency or tours procured using the service, or for any other claim related in any way to your use of the service, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service, posted, transmitted, or otherwise made available via the service. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

This website is owned by VIAJES ANITA, which will make every effort to properly manage and organize reservations for programs, tours, and other services offered on the site. The images shown on the site are for illustrative purposes only and may not, in all cases, match the locations included in the programs.

VIAJES ANITA is not responsible for the consequences of any improper or negligent act, omission, or failure of one or more of the services managed by its suppliers, such as transportation, hotels, cruises, or any other activity and/or service that is not directly owned or controlled by VIAJES ANITA.

VIAJES ANITA shall not be liable in any way for any loss, injury, death, or damage to persons and/or property caused directly or indirectly by accidents related to weather, earthquakes, tsunamis, fires, machinery or equipment breakdowns, acts of government or other authorities, declared or undeclared wars, strikes, riots, thefts, epidemics, quarantines, medical or customs regulations, terrorist activities, or any other action, omission, or condition beyond our control. VIAJES ANITA and its associates shall not be liable for any additional expenses or charges arising from the liability and/or negligence of clients/passengers who contract the services offered, or as a result of the aforementioned causes.

VIAJES ANITA will not be responsible for any loss, injury, death or damage to persons and/or property, nor for any accidents that may occur when using any of the services offered by VIAJES ANITA and/or its suppliers.

SECTION 18. INDEMNIFICATION

You agree to indemnify, defend and hold harmless VIAJES ANITA, our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
